South African court allows Zuma-Sambudla incitement trial to continue

Published November 6, 2026

What the court decided

On November 6, the High Court in Durban refused Duduzile Zuma-Sambudla’s request for discharge after prosecutors finished presenting their case. She faces one count of incitement to commit terrorism and two counts of incitement to commit public violence. The prosecution relies in part on social media posts made before and during unrest in KwaZulu-Natal and Gauteng in July 2021.

What remains for trial

The defence argued that prosecutors had presented too little evidence for the case to proceed. At this stage, the court asked whether the prosecution had presented evidence on which a reasonable court could convict if the evidence went unanswered. The refusal means the trial can continue. Zuma-Sambudla remains presumed innocent, and the prosecution must still prove its case beyond reasonable doubt.
